
Overture Privacy and Data Protection Policy
Overture is a cloud-based application (the ‘service’) owned and operated by Curious Ferret Ltd.
It is our stated policy that we will only collect, store and process the minimum level of personal data relating to our clients as is required in order to provide and continuously strive to improve the service.
Generally
We collect the e-mail addresses of those who communicate with us via e-mail or our corporate website, bookingwithoverture.com, aggregate information on what pages consumers access or visit, and information volunteered by the consumer (such as survey information and/or site registrations).
The information we collect is used to improve the content of our web pages and the quality of our service, and is not shared with other organisations for commercial purposes, except:
- to provide products or services our clients have requested (including the provision of Overture Accounts and where appropriate linking or facilitating the linking of these to compatible third-party applications or software such as Dropbox, Campaign Monitor, Stripe or Dropbox Sign),
- when we have their permission, or
- under the following circumstances:
- It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law.
- We transfer information about our clients and others who’ve been in contact with us, if Curious Ferret or Overture is acquired by or merged with another company. In this event, Curious Ferret will notify you before information about you is transferred and becomes subject to a different Data Protection policy.
We never sell or ‘mine’ data.
Information Gathering and Usage
When an organisation registers for Overture we ask for information such as their name, company name and email address.
Curious Ferret uses collected information for the following general purposes: provision of products and services, billing, identification and authentication, services improvement, contact, and research.
With specific regard to our clients’ accounts (subdomain.overturehq.com or ‘Overture Accounts’), we host the content on behalf of our clients and only access it with the specific purpose of providing technical support following a request for such which may be received via email, telephone or our support portal.
Content Ownership
We acknowledge that the data content of these Overture Accounts is the property of our clients and we claim no ownership of it. Such content is expressly the property of our clients and remains so.
We will also provide a letter of acknowledgement of confidentiality and non-disclosure signed by a Company director to any of our client account holders who require it.
Cookies
A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's computers and stored on your computer's hard drive.
Cookies are required to use the Overture service.
We use cookies to record current session information, but do not use permanent cookies. You are required to log-in to your Overture Account after a certain period of time has elapsed to protect you against others accidentally accessing your account contents.
Data Storage
Curious Ferret uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run Overture. Although Curious Ferret owns the code, databases, and all rights to the Overture application, you retain all rights to your data.
Our data hosting partner is Amazon Web Services (‘AWS’) and the main AWS Data Centre we use for the purpose of hosting Overture accounts is located in Dublin, Ireland.
Encryption
All data used in the provision of the service is encrypted at rest and in transport.
Deletion
Should any of our clients choose to discontinue their use of the service we will advise them of their right to have their data deleted and agree a timescale for the removal and deletion of their Overture Account and its contents.
Disclosure
Curious Ferret may disclose personally identifiable information under special circumstances, such as to comply with relevant legislation or associated regulations or when your actions violate the Terms of Service.
Changes
Curious Ferret may periodically update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the email address of the Overture Account holder or by placing a prominent notice on the dashboard of all Overture Accounts.
